Fair pricing now has to be provable, not just assumed
UK insurers are under growing pressure to demonstrate — not merely assert — that AI-driven underwriting, pricing and claims decisions produce fair outcomes. A structured ADM assessment gives underwriting, pricing and claims teams a single, audit-ready record for every automated decision point in the policy lifecycle.
Explainability is now a competitive requirement, not a nice-to-have
UK insurers have taken a more measured approach to AI than global peers, deploying it in specific, provable use cases such as claims processing and quote generation rather than end-to-end automation — a strategy shaped as much by regulatory expectation as by operational caution. The FCA's 2026 focus on proving fair pricing outcomes means insurers can no longer treat automated underwriting or pricing models as a black box; they need to show the reasoning behind each decision.
Underwriting declines, automated pricing adjustments, and claims-triage systems that fast-track or reject claims without adjuster review are all candidates for Article 22A classification. Because underwriting frequently uses health, disability or lifestyle data, the Article 22B special-category regime is directly relevant, and a documented condition (explicit consent, or contract necessity plus a substantial public interest condition) is required before automated processing can proceed.
A mid-sized insurer running automated claims triage
An insurer's claims system automatically fast-tracks low-value claims and flags others for investigation based on a fraud-risk score, with no human review for either path. Underwriting uses a separate pricing model that adjusts premiums based on lifestyle and health-adjacent data points. Illustrative example — not a real client or verified statistic.
Claims and pricing decisions run automatically with no documented basis for special-category data use.
Each system is classified, its lawful basis and special-category condition documented, and a DPIA completed where risk is high.
Where to start
- Classify claims-triage and underwriting-pricing systems against Article 22A and 22B separately, given the special-category data involved.
- Document the specific Article 9 condition relied on for any health, disability or lifestyle-derived pricing factor.
- Build a proactive Article 22C safeguard: a route for policyholders to request human review of an automated decline or pricing decision.
- Complete DPIAs for any system profiling policyholders at scale.
